Arvind Kejriwal sent to judicial custody in Gadkari defamation case

New Delhi: Former Delhi chief minister Arvind Kejriwal was on Wednesday sent to judicial custody till May 23 after he refused to furnish a bail bond in connection with a criminal defamation complaint filed against him by BJP leader Nitin Gadkari. 

The court, while passing the order, said that the AAP leader was looking for "some exceptional treatment". The court also ordered the Delhi Police to take Kejriwal into custody and shift him to Tihar jail. 

The order was passed after Kejriwal refused to give an undertaking and furnish a bail bond of Rs 10,000.

Kejriwal, who today appeared before the court in pursuance to the summons issued against him, told Metropolitan Magistrate Gomati Manocha that he was ready to give an undertaking that he will appear before the court but refused to furnish bail bond to secure bail. 

During the hearing, the magistrate observed, "I completely agree but why he (Kejriwal) will not furnish bail bond. What is the problem. There is a procedure and why should we follow different procedure in this case.” 

"I agree he will appear in the court but the procedure is that a person has to file bail bond. Are you looking for some exception treatment?" the court asked. 

Kejriwal, who also argued in the court, told the judge that he has not committed any heinous crime and added that he was not looking for any exceptional treatment. 

"This is my principle that when I have not done anything wrong, I will not seek bail. I am ready to go to jail," he said. 

Advocates Prashant Bhushan and Rahul Mehra, who appeared for Kejriwal, told the magistrate that these cases are of political nature and as per the principle of Aam Aadmi Party (AAP), they will not furnish bail bond. 

Bhushan also argued that there was no possibility that Kejriwal would tamper with the evidence or influence the witnesses and filing of undertaking was correct. 

Senior advocate Pinki Anand, who appeared for Gadkari, opposed the contentions of defence counsel, saying there was no procedure in law to furnish undertaking and law should not vary for anyone. 

The court after hearing the arguments advanced by both the parties reserved its order for 4 PM on the issue of filing of undertaking by Kejriwal.

திரு. மன்மோஹன் சிங் அந்த ஈனச்செயல்களை இத்தனை வருடங்களாக ஏன் பொறுத்தார்? கைநாட்டுச் சிறுவன் வசையை ஏன் ஜீரணம் செய்தார்? டாக்டர் அப்துல் கலாம் ஜனாதிபதியாக இருந்த போது, தான் நன்கு அறிந்து டாக்டர் பட்டம் பெற்ற பிரிட்டீஷ் நாடாளுமன்ற நற்பண்பு உத்தியை, தரம் கெட்ட இந்திய நாடாளுமன்ற அங்கத்தினர்கள், சோனியா முதல், ஆதாய பொறுப்புகளை வகிக்கலாம் என்ற வகையில் துஷ்பிரயோகம் செய்ய இருமுறை ஏன் பரிந்துரைத்தார்? அண்மையில், உச்ச நீதி மன்றத்தின் கண்ணியமான தீர்ப்பை நீர்மையாவதற்கு, தன்னிடம் பணி புரிந்து, பின்னர் ஜனாதிபதியான ப்ரணாப் முக்கர்ஜி அவர்களிடம் ஏன் வாங்கிக்க்கொண்டார்? ஒன்றுக்கும் பதில் இல்லை. அவர் ‘திறந்த புத்தகம்’ எழுதுவாரா என்பதே கேள்விக்குறி.
நான் மிகவும் மதிக்கும் ஒருவரை இவ்வாறு விமர்சனம் செய்ததற்கு, நான் என்னிடமே மன்னிப்புக் கேட்டுக்கொள்கிறேன்.

I give credit for these successes to all of you. However, there is still vast latent development potential in our country and we must collectively work hard to realize it.
As I leave office, my abiding memory will be the love and kindness that I have always received from you. I owe everything to this country, this great land of ours where I, an underprivileged child of Partition, was empowered enough to rise and occupy high office. It is both a debt that I will never be able to repay and a decoration that I will always wear with pride.
Friends, I am confident about the future of India. I firmly believe that the emergence of India as a major powerhouse of the evolving global economy is an idea whose time has come. Blending tradition with modernity and unity with diversity, this nation of ours can show the way forward to the world. Serving this nation has been my privilege. There is nothing more that I could ask for.
I wish the incoming government every success as it embarks on its task and pray for even greater successes for our nation.

கடந்த மூன்று நூற்றாண்டுகளில், சுதந்திர தினத்தைத் தவிர, இன்று தான் பாரதமாதா களித்திருக்கும் நாள். இந்த தருணம் இனி கிட்டாது. நான் மதச்சார்புள்ள அரசை நாடுபவன் இல்லை. ஆனால் ‘பிணம் தின்னும் சாத்திரங்களும்’, பேயரசு புரிவதும் நமக்கு உகந்தவை அல்ல. கடந்த அறுபது ஆண்டுகளில், குறிப்பாக, கடந்த ஐந்து வருடங்களில் நாம் கொடுத்த விலை: கொள்ளையடிக்கப்பட்ட பல லக்ஷம் கோடி ரூபாய், அயல் நாடுகளில்  அவிழ்த்துப்போட்டு நின்ற அவமானம், உள்நாட்டில் பொது நலம் கற்பழிக்கப்பட்ட நிலை, கூடா நட்புகளின் மயானக்கூத்தும், மற்றும் பல சொல்லக்கூசும் அவலங்களும். இந்த நிமிடம் வரை சூன்யம் பெற்று கின்னஸ் ரிக்கார்ட் தி.மு.க.வுக்கும், அண்ணல் காந்தி ஒழிக்க விரும்பிய காங்கிரஸ் கட்சிக்கும், முழங்காலுக்கும், மொட்டைத்தலைக்கும் முடிச்சுப்போட்டமாதிரி, கொள்கை உடன்பாடு கிடையவே கிடையாது. ஆனால், இரு கட்சிகளும், மற்றும் சிலதும், ஒன்று சேர்ந்து தீவட்டிக்கொள்ளைக்காரர்களாக, நம்மை, நம் கற்பை, நம் நலனை சூறையாடின. சுடுகாட்டுக்கூறை முதல், பிரபஞ்சத்து 2ஜி வரை, வராக பூமியின் தாதுகள் வரை, ஓட்டப்பந்தயம் வரை, ராணுவ சவப்பெட்டி வரை, போர்வீரர்களுக்கான இல்லங்களை, ‘ஆதர்ஷமாக’ ஜீரணித்து, காசு பார்த்து விட்டு, மானம், வெட்கம் இல்லாமல், புண்சிரிப்புடன் வளைய வருகிறார்கள்.

√ தமிழ் நாட்டிலும், டில்லியிலும் ஆட்சி பவர் ஆஃப் அட்டர்னி பெற்ற தனி கட்சிகள், அடக்கத்துடன் நடக்க வேண்டும்.
√ மக்களுடன் உரிய ஆலோசனைகள் பெறும் வசதியை உருவாக்க வேண்டும். டாக்டர் மன்மோஹன் சிங் முதல் தடவை பதவி ஏற்ற தினமே, இங்கிலாந்திலிருந்து அவருக்கு ஒரு கடிதம் எழுதினேன். அடக்கத்துடன், இந்தியா வந்து தற்புகழ் நாடாமல், வருமானம் நாடாமல், ஆவன செய்வதாக வாக்குக் கொடுத்தேன். என் தன்னார்வ குழுவும் ஆதரவு அளிப்பதாக கூறியது. அவருடைய அலுவலகம் அன்றே அந்த ஃபேக்ஸ் வந்து விட்டது; பிரதமர் முன் வைப்போம் என்றார்கள். ஆனால், புறக்கணித்து விட்டார்கள். அதற்கான விலை கொடுத்தது பத்து வருடங்களுக்கு பிறகு. அதற்குள் நாம் மானம், மரியாதையை இழந்து விட்டோம். 

√ உச்ச நீதி மன்றம், கண்காணிப்புத்துறை, தணிக்கைத்துறை தான் பாரதமாதாவின் மெய்காப்பாளர்கள். அவர்களின் பணிகளை பற்றி முழு விழிப்புணர்ச்சி மக்களுக்கும், அவர்களுடன் கபில் சைபாலின் உளரல் போல் இல்லாமல், பண்புடன் பழகுவது, அன்னைக்கு மரியாதை.
√ கண்ணியமான ஜனநாயக அரசியலுக்கு, பாரபக்ஷமின்மை, கறார் நிர்வாகம், மக்கள் நலத்துக்கு முன்னுரிமை, தொலை நோக்குப்பார்வை, நம் சங்கத்தமிழ்/காப்பியம்/ கூறும் அறம், அவசரத்தேவை. செல்வி ஜெயலலிதாவும், திரு.நரேந்திர மோடியும், அதிகார செறுக்கால் கெட்டுப் போகாவிடின், இவற்றை நிர்வகிக்கும் திறன் உள்ளவர்கள். அவ்வாறே இயங்கவும் வேண்டும்; அதை வெளிப்படையாக ஆவணப்படுத்த வேண்டும்.
√ தற்காலம் பதவி வகிக்கப்போகும் கட்சிகளிலும் சமூக விரோதிகள் உளர். அவர்களை இனம் பிரித்து, நச்சுப்பல்லை பிடுங்கவேண்டும்.
√ டில்லியில் புதியவர் பதவி ஏற்குமுன், பழைய பெருச்சாளிகள் ஆவணங்களை எரித்து விடுவார்கள். அதை தடுக்க காவல் போட்டிருப்பார்கள் என நம்புகிறேன்.
√ பல குற்றங்கள் பற்றிய செய்திகள் வாந்தி எடுக்கப்படும். நாடெங்கும், புதிய அரசுகள் குற்றங்களை விரைவில் விசாரித்து கடும் தண்டனை கொடுக்கவேண்டும். கையாடப்பட்ட சொத்தை பிடுங்கவேண்டும்.
இன்னும் சொல்ல எத்தனையோ? யார் படிப்பார்கள்? யார் பார்ப்பார்கள்?
